How do you prove mens rea?

Rate This Answer

In jurisdictions with due process, there must be an actus reus accompanied by some level of mens rea to constitute the crime with which the defendant is charged. In sum, it depends on the type of crime and the statutory language of the crime. You have to prove the person was in the right state of mind to commit the crime in question.
