If I was walking on the street and and a car hit me, can I sue them?
Due to the structure of the American legal system, in most states you can sue someone for anything--but the real question is if you'll win. If you were near the curb and the driver chose not to swerve around you, you'll have a good case. However this is something difficult to prove in court, and expenses will probably outweigh any claims. ChaCha!
